With the ever-evolving technological and business landscape, there is a need for effective protection of personal data. In Singapore, the collection, use, disclosure and care of personal data is regulated by the Personal Data Protection Act (“PDPA”) which has been in force since 2012. The Personal Data Protection (Amendment) Bill 2020 was published in May 2020 for public consultation to ensure that the PDPA keeps pace with the changes and transformation in the digital economy.

Some proposed amendments to the PDPA include, amongst others, increasing financial penalties for breaches of the PDPA, implementing mandatory data breach notifications to the Personal Data Protection Commission and affected individuals, expanding the definition of “deemed consent” and introducing new exceptions to consent, and enhancing protection against unsolicited telemarketing and spam.
